This position may be hired as an Adjuster or Senior Adjuster, depending on years of relevant work experience. You will primarily handle subrogation but also may handle arbitration based on business need.
What You'll Do
As a Senior Subrogation Adjuster, you will:
Subrogation Recovery
- You will present auto subrogation claims on behalf of the Company/insured based on file analysis for low to high complex files. Prepare cases for arbitration and leverage arbitration forums.
- You will create communication strategies with adverse carrier or claimants and negotiate settlement recovery on low to high complex auto subrogation claims.
- You will recommend subrogation files for litigation to counsel.
- You will obtain skip trace asset reports to maximize recovery opportunities and coordinate recovery efforts by applying all available options through governmental agencies including DMV/DOT.
- You will pursue and monitor restitution through government entities (e.g. district attorneys, city attorneys, county attorneys). Identifies bankruptcy filings and files Proof of Claim to appropriate court. May attend court hearings.
- Makes independent decisions and self-supervises most files and recognizes when assistance is needed.
Analyze and Evaluate Factual Evidence and Subrogation Potential
- You will recognize and document potential liability exposures and secure data in which the file may be lacking.
- You will handle all aspects of subrogation from initial identification through conclusion.
- You will apply applicable case law and statutes, considering geographic location and local ordinances.
- You will recognize potentially fraudulent activity; utilize SIU, Medical Services and other sources.
Securing Factual Evidence
- You will determine if damages are accident/incident related.
- You will obtain evidence and information to maximize subrogation potential and control expenses.
Filing and Responding to Arbitration Cases (based on need)
- Understand how to write and respond with quality contentions to obtain a favorable result for subrogation claims on behalf of the Company/insured based on file analysis for simple to complex files.
- Prepare cases for arbitration.
- Obtain additional investigative and damage support evidence and can apply information received to maximize recovery opportunities.
- Files intercompany arbitration on simple to complex vehicle damage, property, medical reimbursement claims, contribution claims, and concurrent coverage disputes.
- Understand fundamental aspects of claim investigation and elements of damage for presenting a prima facie tort liability case for recovery on files assigned within their authority.
Hear Arbitration Cases
- Obtain certification as an arbitration panelist through Arbitration Forums
- Hear and decide the outcome of arbitration filings from other companies as an arbitration panelist following management directives.
Training and Additional Assignments
- You will provide advice and opinions on subrogation claims as requested by company personnel.
- You will stay current on new and/or changing statutes, case laws and subrogation-related topics/issues, procedures, and technology.
- You may prepare and conduct training and assist co-workers.
- Serves as a mentor and subject matter expert for less experienced adjusters.
What it Takes
- Five or more years auto liability claims experience required for senior level. Three or more years auto liability claims experience required for adjuster level.
- Claims Center/Guidewire experience and/or E-Subro Hub experience preferred.
- Demonstrated experience providing customer-driven solutions, support or service.
- Demonstrated experience handling 1st and 3rd party, multi-line claims.
- Demonstrated experience handling simple to moderately complex.
- Extensive knowledge and understanding of policies and endorsements.
- Extensive knowledge of each phase of the claim handling process.
- Obtain state specific property casualty adjusters claims licensing as required within 90 days.
- Travel Requirements up to 10%.
- Work that primarily involves sitting/standing.
